1. The entire case against Margarito rests solely on circumstantial evidence.
2. The main point of Tony’s detractors is based upon the standard of “strict liability” and it would be an injustice to allow false speculative opinions to decide Margarito’s guilt.
3. It is an accepted principle in criminal law that where there is doubt the benefit should be given to the defendant.
4. The taking of illicit drugs is very different. The boxer has the option of seeking proper advice on the content of any substance PRIOR to use.
5. The inserts were not visible to trainer Nazeem Richardson who was, presumably, looking for wrongdoing, so it is unlikely they were seen by Margarito.
6. The only evidence available on whether boxer Margarito knew of the knuckle pads is in the voluntary statement made by trainer Capetillo who completely exonerated Margarito of all blame.
7. With such a traumatic incident happening shortly before boxer Margarito was preparing to box Shane Mosley, it’s no wonder that Margarito’s performance was directly effected.
8. Mind games are a notorious ploy of Nazim, which means it could have had the desired effect.
9. There is no evidence available that boxer Margarito was present when the knuckle pads were illegally prepared.
10. Equally there is no reliable evidence that points to boxer Margarito having prior knowledge of the unlawful pads until they were discovered. Any otherwise presumption is pure speculation.
11. The knuckle pads were not used so the charge could only be one of attempting to use illegal knuckle pads.

Emanuel Steward, Don Turner, Dan Birmingham, Pat Burns, and Naazim Richardson have all gone on record saying that it is not only possible but easy to insert doctored wraps into their boxer’s wraps.

DAN BIRMINGHAM: “My guys watch me closely when I wrap. But what you’re talking about here happens pretty quickly. The pad goes on and then you put more gauze over it. So sure; it’s possible that the fighter wouldn’t know.”

PAT BURNS: “Even if a fighter is watching, they’re not wondering what’s in the knuckle pad. If I wanted to put a few layers of hardened gauze inside a fighter’s knuckle pads, I could and the fighter would never know.”

DON TURNER: “If I wanted to, unless what I was putting into the knuckle pad was very heavy, I could do it in a way that the fighter wouldn’t know. Even if the fighter is watching me wrap, he might not know because he wouldn’t see or feel the difference.”

EMANUEL STEWARD: “In a situation like this, it’s definitely possible that a trainer could put an insert in the knuckle pad without the fighter knowing. The fighter doesn’t watch me make the knuckle pads. A lot of times, the fighter isn’t even there when I make them. So the fighter wouldn’t know if I put something inside the pads unless I told him or the pads were heavy enough that he could feel a difference.”

NAZIM RICHARDSON: “To be fair, yes, a fighter might not know.”

Reasonable doubt? that’s all it takes.

It was actually a prescription med from a doctor to raise my testosterone level up to normal.” … So you test positive… Then you say “NO WAY” and ask for another test… Then when sample “B” comes in positive you come up with a creative excuse??? And your favorite org. lets you keep one of your World Title???

BTW… Roy Jones tested positive for “Androstenedione” in 2000 after a major title fight.

In 1997, the International Olympic Committee banned Androstenedione and placed it under the category of Androgenic-Anabolic Steroids. You would think that Roy, being a former Olympian and Super-Star Pro Champion, would be better informed by his Team about Androstenedione being banned by the IBF. But who knows?

So, Roy Jones is supposed to get a pass for testing positive for PEDs after a major title fight in the pros, but VK doesn’t get the same pass for being directed by a Dr. to take a medication to treat a leg injury as a young amateur?

Androstenedione is also banned by the NFL, MLB, USOC, NCA, and the NBA. In 2005, James Toney tested positive for the anabolic steroid Stanozolol. Frankly, there’s just no way to make-up excuses for that type of blatant violation.

That’s exactly what happened and it went down when Vitali was just a young, naive amateur who was given some sort of medication to treat a leg injury. He was not aware of it, but the medication had some type of banned substance in it. But he has already paid a heavy price because he was kicked off the Ukrainian Olympic team, and he would’ve won the Gold Medal at Super HW, while Wlad would’ve won the Gold at HW. Not getting that Gold Medal is probably one the greatest regrets/disappointments of his entire life.

So there’s no way in H3LL it’s going to keep VK out of the HOF or from being considering one of the top-3 ATG HWs.

You may not like their style, but the K-Bros are full of integrity, class, honor, sportsmanship and sincere concern for the chaotic state of Ukraine and other major crises going on throughout the world — like starvation and AIDS.

It’s kind of like these two brothers were born & bred to become HW World Champions. And they were smart enough to understand the value of their almost super-human natural gifts at a young age and took full advantage of them. Can you honestly blame them?

They’ve never had a need to cheat their way through their pro careers with PEDs. Just look at their freakish genetics! They never needed PEDs to have the natural physical advantages over almost every other HW on the planet.

Barry Bonds and Big Mac suffered numerous injuries to knees shoulders and arms..

Roy tested positive for Ephedrine.. That’s a fat burner not a steroid.. He had a false positive test for a steroid when he fought Richard Hall.. The follow up tests were negative.. Hall tested positive initially, but sample B came up negative for PEDs for both combatants. Holyfield also had numerous shoulder injuries which cost him is 1st Moorer fight and his Byrd fight.. He is notorious for using the phony name “Evan Fields” when being prescribed steroids.

Supreme Court, almost everyone I know who took steroids back in the 70’s and 80’s had some kind of joint, muscle tissue, or connective tissue damage they suffered from.. STRONGMAN was on here listing the dozens of injuries he suffered.

You said Conte has so many other boxers he works as a nutritionist for… But you can’t name and other World Champions he works with or worked with that have been free of these promblems… Berto, Ward, Donaire, have all been world champions and Chambers is actually a World Champion caliber boxer. Funny they all suffered from shoulder injuries and tissue damage … Name 4 other guys at the World Level who Conte works with who HAVEN’T had these problems.

the stoppage was premature if you wanted to see Berto get grotesquely battered into a heap. For a moment after he got up he looked like Zab Judah after Kostya Tsyu hammered him (the chicken dance!). That said, what is ominous about Berto is that he got pounded by what I thought was a very mediocre performance by Soto-Karass- how slow can a man punch? I have never seen punches that slow and still Berto couldn’t get out of the way, or dodge.

They mess your body up and the growth rate of muscle tissue vs connective tissue is often not symmetrical or coordinated well by your body when you abuse it with steroid use … Not only that, but steroids mess with your heart, liver, brain, testicles, and other organs.. Particularly when they incorporate masking agents and other chemicals to avoid detection by the latest sophisticated testing procedures … which are getting better all the time BTW.

The good guys are getting ahead of the crooks for a change.

Berto is not done, things to be done a bunch of easy fights, rebuild confidence and sharpen skills again. Berto needs to get in the ring with about 4 to 5 tomato cans to get back into the swing of things. He can stay at welter weight stay off the weights. He needs to move his head more. The only way I would say retire, if anyone on this sight noticed his balance was a bit off. If that continues to be a problem it is time to quit for Berto because then he might be having other problems.

I have saw several people say that these injuries that berto has sustained came from steroid use. I’m not sure if I agree, I always thought that the steroid use was to ward off injuries to allow the athlete to train longer and harder. I would think that it would be the over use of weights and not properly stretching that would cause the torn muscle and not using PED/Steroids would cause the inuries that he has. After being caught using steroid this to me seems like the more logical explanation.

Even if Berto would have been given the benefit of the doubt he still lost the fight unanimously IMO. I don’t know wtf the judges were looking at smh.. I’m not sure what happened to Berto the past few years… … He was getting rocked since the first round of the fight. The shoulder roll defense works… You can use it to defend lefts or rights.. It doesn’t matter what style or stance your opponent has.. It all depends ton the angle and trajectory of the punch that’s coming at you. You never use it from distance on a straight power shot or jab. You use it on a round house swing, a blooping punch, or a wide hook from either side. It’s not one shoulder or another. The punch that’s coming determines if it’s employed.

Berto just can’t defend because his stance is the most fouled up thing I’ve ever seen … He can’t really throw a jab or straight right without leaving himself wide open for a counter because his feet and torso are dead wrong.

I don’t know if Berto’s career is finished or not, but one thing’s for sure: He needs to stop trying the shoulder-roll defense. It didn’t work for him against Guerrero & it didn’t work for him against Karass because he’s not any damn good at it. He just needs to bob & weave to get out of the way. If he does that, I think he’ll have more success. As far as Berto fighting at 140 instead of 147, that might be a good idea.

Plus you have to be able to anticipate certain punches being thrown and Beeto doesn’t have that in him. He should try and move down to 140 but the only problem is they have some good hard punchers in that weight class also. He really needs to retire from boxing. He can still be associated with it but he doesn’t need to be the one fighting

For the shoulder roll to be effective, you gotta have the reflexes and the footwork.

Berto has lead in his shoes and shuts his eyes up close when throwing his hooks.

A lot of muscle mass up stairs and looks like he may struggle at 147lbs.

It was only the next step when Berto held a title. Berto coming off 2 losses does not qualify a fight against the great Mayweather. Soto is only a gate keeper. He can be satisfied with that because he can still get these fights against some of these top prospects connected to big managers like Al Haymon.

Wow. I was totally wrong about Berto. I bought on the hype when Berto had that one punch KO against a taller boxer 3 or 4 years ago on HBO. I thought he may be the ONE to beat Mayweather or give Mayweather the fight of his life. I Didn’t know he failed the PED test. I must have been sleeping. Anyway, Berto may be the example of how the shoulder roll is overutilized or misused by these boxers who want to copy Mayweather too much. Should keep both hands up. Berto should join his bros who are in MMA but then those guys are even more monstrous. I don’t think Berto can fight in a lighter weight class because he just has too much muscles and looks like a body builder. Maybe Karass will get a fight against Mayweather since that is the next step for anyone that KO’s Berto.

“Andre Berto should have been given the benefit of the doubt!” according to the “official” scorecards, Berto WAS receiving a generous benefit of the doubt. it’s fortunate that the ref didn’t play along and ignore that Berto was virtually out on his feet. besides, the ref must’ve also assumed that Berto was hopefully behind and couldn’t possibly improve on his performance during the previous 11 rounds. good call by the ref who may have unwittingly foiled the “official” but treacherous scorecards.

i’ve seen notable improvement in Soto Karass’ ring-style. not as dramatic as Barrera’s but he’s actually picking his shots and benefiting from His range. his grit and stamina are indisputable and his execution while not flawless has become increasingly effective. a rematch v. Karass really worked Berto over throughout the whole fight. The ref was asking Berto at the end of the 9th round if he was okay. Karass really put a whipping on Andre. Berto put on one of the worst boxing performances that I have ever seen. Zero defense, terrible stance, no balance, no ability to adjust to his opponent, and no friggin’ intelligence. Berto continued to try to fight inside even though Karass kept pummeling him when he was in there. Berto took so many punches to tthe head, I’m surprised the ref didn’t stop the fight sooner, even though Berto was still swinging. Good stoppage by the ref however. Berto had taken a real beating and even though he quickly staggered to his feet, he had taken too much of a beating already.

BTW, Berto should change his name to “Puffy.” You know how he likes to make his face swell up.

the attempted robbery of Soto Karass is another example of why foreign fighters need to arrive to the U.S. with the mind-set of winning by KO. it’s the only certain way for them not to be robbed by promotional and “official” scorecards in the U.S. it’s also another good reason for open scoring. scrutinizing the “official” scores on a round-by-round basis would expose the skunks who are either corrupt or simply incompetent or Both. Btw, open-scoring would’ve allowed Berto to confidently focus on defending and pot-shotting; compelled Soto Karass to crank up his aggression; and the same numbskulls who describe Canelo v. Trout as “close” would be praising Berto for his dominant boxing performance. however, that would be underestimating Soto Karass. with or without open-scoring, his performance last night yields the same result. Berto just can’t avoid being hit Hard and Often.

I can understand why Berto was upset the guys career was on the line. Refs seem to judge stoppages according to a guys durability and Berto is one tough s.o.b. Just look at how Bradley was allowed to continue against the Russian. Granted Bradley was winning so there was a difference. I do think he should’ve had an 8 count before waving the fight off but at the end of the day im all for protecting fighters for themselves. Man if Bertos healthy i see no reason why he can’t take another crack at it hes been very competitive in all his loses.

Good stoppage. You have to factor in how much punishment and the cumulative amount of damage he’d taken up until that point. His legs were gone and he could’ve gotten seriously hurt had the referee allowed it to continue, especially bearing in mind all the cumulative amount of punishment he’d taken and that his opponent was hitting him at will all night, even when he was fresh. Soto Karras throws every punch in the book and he would’ve immediately pounced on Berto and had him over again in a matter of seconds.

Berto is and always has been a hype job. He’s decent and has got a big heart but he was never as good as people hyped him up to be.

Berto should retire?! Why on earth should he retire. He’s a boxer, in a fight there has to be winner and a looser, if all boxers quit after loosing a few fights there would be no one out there. Its this kind of attitude in the sport stops big fights being made as fighters are scared stiff of actually loosing a fight. Boxing needs to drag itself away from this attitude and look at the super six as inspiration on how it should be run. Froch, Ward, Kessler, and Abraham were in top fight after top fight. Ok Berto has lost a few now but he’s still entertaining to watch and I would love to see him back in the ring against the likes of Marquez, Bradley, Alexander, Brook or even Maidana.

Berto was ROCKED, badly HURT and his shoulder was way too injured to continue. It was a good stoppage as far as I’m concerned. At the end of the night, these fighters need to avoid as much brain damage as possible, so that they have their faculties about them for the rest of their lives after boxing.

I have no desire to see boxers get killed in the ring, and it has happened more than enough times over the decades. I watched Sergey “Krusher” Kovalev kill a guy in the ring just a couple years ago. And I’ve seen the footage of Paret getting beaten to death by Griffith. I don’t ever want to see that type of tragic madness again.

Go back and watch the first fight of the famous Ward vs. Gatti trilogy (YouTube). It is considered by many experts to be the “Fight of the Century” and round 9 is considered one of best rounds in boxing history.

Ward hit Gatti with his trademark left hook to the liver and Gatti went down. His face was showing he was in serious pain. But he beat the count, got up and they kept exchanging with Gatti gaining back the momentum. Then Ward came back like a machine and was absolutely beating the living H3LL outta Gatti in the corner. There was a short time in round 9 when Gatti was totally out on his feat and 73-year-old Frank Cappuccino should’ve stopped the fight. But he let it continue… and Gatti lost the fight anyway.

My point is that boxing is a sport — and although it’s violent and dangerous, it’s not supposed to be a fight to the death. Not one man had ever died in a sanctioned MMA fight. There are several reasons why that is, but that’s a whole different discussion. Real talk.

No way…, When you get up you’re supposed to face the referee, not walk or stumble sideways. Some referees are pretty lenient about this, but most do their job. When Malik Scott got up from an illegal blow to the back of the head at the count of 9 he faced the referee.

Berto jumped up too early like Judah did vs Tszyu. He has enough experience to know not to do that.

The first job of any referee is to make sure a shakey fighter is not allowed to continue … because a career wrecking episode may ensue.

Berto should have been given an 8 count, but his best days are over. He doesn’t have anymore and should retire. His torn bicep and injured shoulder are likely results of his Ped use. You may get fast results, but when you are busted and have to let them go, your body pays for it as his is doing right now. Pay attention future boxers and athletes, cheating with Peds aren’t worth it.

The Truth Teller, I agree with you about Nihito Arakawa taking unnecessary and perhaps permanent punishment. However, if the referee stops the fights in those circumstances, he’ll probably be accused of fight fixing. For that reason I can’t blame the referee.

The biggest issue is the fighter’s corner. One would want to think that a corner would really be concern about their fighter’s health more than about a win. After all, what good does a win makes is the fighter becomes damage good due to the amount of punishment? Arakawa’s corner needed to step in and protect him, but chose not to.

As for Berto, he was out…no reason to let him continue. It was a monstrous left by Karass and Berto’s legs were gone. Berto should consider retirement. Three loses in a row; has taken lots of punishment; also, as PEEJ mentioned, illegal substances appeared to be taken its toll to his body; and lastly, he has lost to three good, but not great welterweights.
