Frank-Cauthen: No Decision ruling stands

Joe DeGuardia's Star Boxing announced today that the New York Supreme Court agreed with Star Boxing, Team Cauthen and the New York State Athletic Commission (NYSAC) over the "no decision" ruling that reversed the original hotly contested controversial decision after the USBA Jr. Middleweight Title and #2 IBF ranking fight, between Raul Frank (27-5-3 13KO's) and Terrance Cauthen (32-3 9KO's.).

The fight, which took place on January 25, 2007 at the Paradise Theater in the Bronx, was seemingly headed to a certain Cauthen win when referee Ricky Gonzales stopped the fight 2:59 minutes into the seventh round after Cauthen was knocked down and out by a massive head butt. Unfortunately, the referee didn't see the cause of the knockdown, and ruled it a TKO for Frank. This was the beginning of a vigorously contested battle outside the ring, going from the NYSAC to the NY State Supreme Court as both fighters battled for the victory ruling.

Cauthen (32-3-1, 9KO), who was making his first defense of his title, was pitching a shutout on two of the scorecards (60-55) and was leading on the third card (59-55) when Frank bounced off the ropes catching Cauthen squarely on the chin with his head virtually knocking him out on his feet.

After the bout, Team Cauthen protested the fight's outcome and a review and ultimately a hearing was setup at the NYSAC. The NYSAC reversed the initial TKO victory for Frank to a no-decision after NYSAC reviewed the television replay provided by HDNET at ringside and at the hearing at the NYSAC offices. The tape provided conclusive evidence of the head- butt by Frank, and was the basis of the ruling. The Frank camp appealed the determination of the NYSAC to the New York Supreme Court.

New York Supreme Court Justice Walter Tolub signed the decision and order which upheld the determination by the NYSAC.
